Who is the opposition in PBT constitution?


I read the arguments by minorityview.

I believe that the most basic and important question is the definition for "pembangkang (opposition)" in PBT constitution? Was it defined?

If it was not defined then we can have the following interpretation by the existing PBT members.
  • The state government is under Pakatan Rakyat while the federal government is under Barisan Nasional. PBT can decides that Pakatan Rakyat is the opposition.
  • Therefore, all the ex-ADUN and ex-MP wives from BN are still members of PBT by virtue of per Article 5.1 (a) (v) (read below).
  • This also means that Puan Sri Chui Kah Peng never lost her right to be a member of PBT.
  • PBT do not needs to be dissolved.
  • PBT can continue to function as usual and approved new members from wives of new UMNO ADUNs and MPs.
  • Since the membership to PBT is not automatic, Pakatan Rakyat ADUNs & MPs wives application for membership can be rejected by the existing PBT members (Read Article 5.3).
This interpretation will be render useless if the term "pembangkang" was defined clearly. It is best to have the full PBT constitution to argue for whatever interpretations.


Article 5.1 Perlembagaan PBT
Keahlian Pertubuhan BUNGA TANJUNG hendaklah terdiri dari Ahli Biasa dan Ahli Bersekutu seperti berikut:-
a. Ahli Biasa

i. Isteri Ahli Dewan Undangan dan Parlimen bagi Negeri Pulau Pinang kecuali mereka dari parti pembangkang;

ii. Isteri kepada YB Setiausaha Kerajaan Negeri Pulau Pinang;

iii. Isteri kepada YB Penasihat Undang-undang Negeri Pulau Pinang;

iv. Isteri kepada YB Pegawai Kewangan Negeri Pulau Pinang;

v. Isteri bekas Ahli Dewan Undangan dan Parlimen Negeri Pulau Pinang kecuali pembangkang;


Article 5.3 Perlembagaan PBT
Tiap-tiap seorang yang ingin manjadi ahli hendaklah mengisi borang yang disediakan oleh Pertubuhan Bunga Tanjung dan menghantar borang tersebut kepada Setiausaha bersama dengan yuran. Jawatankuasa berkuasa menerima atau menolak permohonan menjadi ahli tanpa memberi apa-apa sebab.

It is confirmed, the constitution is silent on the definition of "opposition".

Puan Sri Chui and the other wives are legally members after GE12.

But, there is a clause which states that the President of PBT shall be the current Chief Minister wife. This means that there will be 1 Pakatan Rakyat member.

Therefore, it is better to dissolve PBT, this Malay proverb sum up the reason - KERANA NILA SETITIK, ROSAK SUSU SEBELANGA
